1. Acceptance of Terms
Welcome to QCTourism, the official tourism platform for Quezon City, Philippines. These Terms of Service ("Terms") constitute a legally binding agreement between you and QCTourism ("we," "our," or "us").
By accessing or using our website (qctourism.sparksoft-demo.com), mobile applications, or any related services (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
Important: You must be at least 13 years old to use this Service. By using this Service, you represent that you are at least 13 years of age.
2. Definitions
- "user" refers to anyone who accesses or uses the Service
- "Content" refers to text, images, videos, comments, reviews, and other materials
- "User Content" refers to Content that Users submit, post, or display on the Service
- "Account" refers to your registered user profile
3. Account Registration and Security
3.1 Account Creation
You may create an account by signing in with Facebook or other authentication methods we provide. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your account credentials secure and confidential
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
3.2 Account Types
QCTourism offers different account roles:
- Public User: Can browse content, make comments, bookmark attractions
- Content Encoder: Can create and submit content for approval
- Content Approver: Can review and approve submitted content
- Administrator: Can manage users, content, and system settings
4. Acceptable Use and Conduct
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Violate any applicable laws or regulations
- Infringe on the rights of others, including intellectual property rights
- Post false, misleading, or deceptive information
- Post spam, advertising, or promotional content without authorization
- Upload malware, viruses, or malicious code
- Harass, abuse, threaten, or intimidate other users
- Post obscene, offensive, or inappropriate content
- Impersonate any person or entity
- Attempt to gain unauthorized access to the Service or other accounts
- Interfere with or disrupt the Service or servers
- Use automated tools (bots, scrapers) without permission
- Collect or harvest personal information of other users
5. User-Generated Content
5.1 Your Content
You may submit comments, reviews, photos, itineraries, and other content to the Service. By submitting User Content, you:
- Retain ownership of your User Content
- Grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content on the Service
- Represent that you have the right to grant this license
- Warrant that your User Content does not violate these Terms or any laws
5.2 Content Moderation
We reserve the right to:
- Review, monitor, and moderate all User Content
- Remove or reject content that violates these Terms
- Suspend or terminate accounts that repeatedly violate these Terms
Content submitted by Encoders requires approval from Approvers before being published. We are not responsible for content submitted by users.

6. Intellectual Property Rights
The Service and its original content (excluding User Content), features, and functionality are owned by QCTourism and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Our trademarks, logos, and service marks ("Marks") may not be used without our prior written permission. You may not:
- Copy, modify, or create derivative works of the Service
- Reverse engineer or decompile any part of the Service
- Remove or alter any copyright, trademark, or proprietary notices
- Use our Marks without permission
7. Tourism Information and Services
7.1 Information Accuracy
We strive to provide accurate and up-to-date information about attractions, events, itineraries, and promotions in Quezon City. However:
- Information may change without notice
- We do not guarantee the accuracy, completeness, or timeliness of information
- You should verify important details directly with venues or service providers
7.2 Third-Party Services
The Service may link to or integrate with third-party websites, services, or businesses (e.g., restaurants, hotels, attractions). We are not responsible for:
- The availability, quality, or safety of third-party services
- The terms, policies, or practices of third parties
- Any transactions between you and third parties
8. Disclaimers and Limitations of Liability
8.1 "As Is" Service
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QCTOURISM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use or inability to use the Service
- Any unauthorized access to or use of our servers
- Any interruption or cessation of transmission to or from the Service
- Any bugs, viruses, or similar harmful components
- Any errors or omissions in content
- Any User Content or conduct of third parties
9. Indemnification
You agree to indemnify, defend, and hold harmless QCTourism, its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.
10. Termination
10.1 Your Rights
You may terminate your account at any time by:
- Visiting the Data Deletion page
- Removing QCTourism from your Facebook Apps and Websites settings
10.2 Our Rights
We may suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason, including:
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- At your request
- For any other reason at our sole discretion
10.3 Effect of Termination
Upon termination, your right to use the Service will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or the Service shall be resolved through:
- Good faith negotiation between the parties
- Mediation, if negotiation fails
- The courts of Quezon City, Philippines, as a last resort
12. Changes to These Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice before any new terms take effect.
By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.
13. Miscellaneous
13.1 Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and QCTourism.
13.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
13.3 Waiver
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.
13.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without restriction.
